XYMARA LTD registered at Evripidou 22, Flat/Office 11, 3031, Limassol, Cyprus is the controller of data, this means that we shall bear responsibility for everything we do with your data (e.g., gathering, keeping, processing).
2. Applicable Legislation
We take privacy of our users very seriously and we follow the provisions of applicable data laws of jurisdictions in which we operate, including, without limitation to the UK’s Data Protection Act 2018, General Data Protection Regulation (EU) 2016/679), the Privacy and Electronic Communications Directive 2002/58/EC (as updated by Directive 2009/136/EC) and the Privacy, and Electronic Communications Regulations 2003 (SI 2003/2426) as amended and all together further referred as “Data Legislation”. Applicable Data Legislation shall be determined by the location of your residence (e.g., in UK it will be UK’s Data Protection Act 2018, in Europe it will be GDPR, etc.). The wording “personal data” in this Privacy policy shall have the meaning described in the applicable Data Legislation. If you have your place of residence in the California USA, the California Consumer Privacy Act may be applicable to you in accordance with provisions of this Privacy Policy.
3. Your Rights
Data Legislation enables users to exercise a number of rights that are related to personal data you provide to us. Such rights may be exercised at any time. Some of the rights listed below, are required by laws of EU or UK, other are applicable to all users of our services as we want to grant you the ability to change amend or alter your consents related to data that you provide to us and provide you with access to your data at any time.
Right to Access Your Personal Data
You reserve the right to request copy of your personal data that we store. You may exercise this right for free and we will answer your request during 14 days (in Europe we will answer your request during 30 days). You can exercise this right easily, just get in touch with our data protection team at dpo@flirtini.com, in such email please attach copy of your ID and a utility bill to verify your address and identity. Copies of documents that you provide to us with your request will be stored for the period of verification and will be erased after such verification is completed and they will be used only for the purpose of verification and provision of response to your request. After the verification of your identity we will provide you with copies of your data. Before provision of the requested data we need to make such verification to be sure that you are the person who you claim to be. If you request data of your chat histories or other records that might contain personal data of third party, we reserve the right to edit, erase or redact such data, except when you have a direct consent from such person that allows us to share such data with you. If your place of residence is not situated in the UK or EU we may charge you with a small administration fee, if we are able to so under the applicable laws of your jurisdiction.
Right to Correct/Amend Your Data
We would like to store the most recent and relevant data about you. So, if you have any amendments or corrections to your data please contact us at: dpo@flirtini.com.
Right to Change Your Consent and Opt Out
You reserve the right to change your mind in relation to the amount of data you allow us to store. You may amend, correct, change or alter your settings via your profile or contact us by: dpo@flirtini.com. Please note that opting out from storage and/or processing of some data may decrease your user experience and you will not be able to use full amount of features available on our services.
Right to be Forgotten (For EU and UK Residents Only)
If you reside in Europe and use our services you may request us to delete all your data upon termination of your use of our services and cancellation of your profile. We reserve the right to store your data for the additional period after the termination of your use of our services and cancellation of your profile, we may do so for security purposes (e.g., in case of police investigation) or for processing of your payments (e.g., as evidence for our charges that were withdrawn from your account if you used paid services). 4. What Data We Collect
We kindly ask you to read this section carefully because it describes what data we collect, process and store upon your consent.
We Collect Your Data When You Sign Up to Our Services, Create, Maintain or Edit Your Profile.
We collect your personal details (which may fall under the definition of personal data of the applicable Data Legislation), including, but without limitation to your user name, real name, telephone, address, date of birth, email address or other data that you may provide us with while registering your profile and/or signing up for our services.
You may also provide us with data about your sexual orientation, ethnic or racial origin or religion. Such data may be defined as sensitive personal data under the applicable Data Legislation so if you provide us with such data you give us your explicit consent to our gathering, processing and storage of such data with the purpose of provision of our services to you.
You also reserve the right to upload your videos or photos to your profile and other data (e.g., text information about your preferences, lifestyle, personality, hobby, interest, etc.).
We Collect Your Data When You Communicate with Us
If you communicate with our customer support team we will store any data you provide to us during such conversation. Please also be aware that we have a right to record and monitor phone calls and written communications for security and training purposes.
If you participate or take part in any competitions, surveys, promotions, events or provide us with any other feedback, we will store such data that you provide to us.
We Collect Your Data When You Use Our Services
We will gather different data if you just use our application (e.g., communicate with other users, browse our app, amend, change or update your profile, or exercise any other activity on our services). Data that we gather:
any data uploaded to your profile (e.g., your videos, photos, etc.) and all other data listed above;
any communications that you send or receive through our services, including with other users;
records of actions you make while using our services (e.g., block lists, likes, search histories, etc.);
data related to any transaction that you make while using our services, including, data that is needed for us to provide you with our services, features or products that you purchased or upgraded (e.g., payment card data);
data from your profiles that you have registered on other social network sites or applications, if you linked them to our application;
data about your location in accordance with IP address of your device that you use to access our services;
Anonymous Data about your usage of our website or application.
Below some of these activities are described in more detailed way and we kindly ask you to familiarize yourself with provisions listed below for you to have clear understanding about our collection of these specific types of data.
Data That We Gather from Other Social Networks That You Use
Our application may link your use of our services to other social network websites or applications that you might possibly use. For example, if you registered a profile with other social network (e.g. Twitter, Facebook, Instagram, etc.) you may share the data you have on our application with such other network. To customize our services for you and improve your user experience we reserve the right to ask you to login to your profile registered on Facebook. If you follow such request you provide us with access to data you have on your Facebook profile (e.g., photos, your personal data, videos, locations, interests, etc.). When you install our application or login to other network you provide us with access to data you have on such network (e.g., gender, name, photos, user ID, networks, friends list, email address or any other data you publicly disclose on such network). When you log into your profile you have on other social network website or application and link such profile to your profile that you have registered on our application you authorize us to post updates on your behalf, e.g., your location data, that is why we ask you to be careful and exercise caution. You reserve the right to turn off disclosure of your location data, if you want to exercise this right please follow the provisions listed below.
Your Location Data That We Gather
We reserve the right to gather data about your location from the device you use, whether computer or mobile device. If you do not want to share the data about your location with us, you may turn off this function in accordance with instructions of your mobile device. We may track your IP address if you use a computer for the purpose of accessing and enjoying our services. To track the location of your mobile device we use GPS tracking with accuracy range up to 100 meters. You cannot be identified by your location data because it is anonymous but it may be shown to other users of our application so please be careful if you do not want to disclose your location data. If you decide to change or alter sharing of your location data or switch off such sharing, we will show your location within the area of the postal code that you provided to us, we will do so in order to provide you with services and matches that will have the closest territorial location to the area in which you reside. We may also use your location data with the purpose of developing new services and products, provide researches of our services, as well as using services of third parties that can help us to provide our services and products to you, develop and design new products and services and/or provide you with targeting promotions and advertisement that will be based on your user experience and preferences. Moreover, your device may provide us with other data about itself (e.g., model, version, brand, version of operating system, mobile service provider, email accounts, installed applications, etc.). We also reserve the right to connect the data about your location from Foursquare with your profile and show your check ins on the map in context of provision of our services.
Data About Your Contacts if You Decide to Share It with Us
You may share your user experience with other persons you have in your contact list and/or send them invitations to join our services. To use this feature, you have to upload data of contacts that you want to invite, this will include their email addresses and names. If you provide us with your password for us to upload such data about your contacts via web based email provider we will erase your password data after data about your contacts is uploaded. You may also send invitations to your friends via other social networks which you connected with your profile registered on our services. You shall bear sole responsibility for ensuring that invitation of your friend or any other contact whom you may invite through email, SMS or application is done after you have received explicit prior consent of such person.
5. How We Use Your Data
Data that we collected from you shall be processed for the following primary aims:
to administer your user profile that you have registered on our services (e.g., send you notifications regarding any announcements, compatible matches, tips, special offers or services, updates or any other notifications that may be relevant to you, if you provided your consent to this);
to improve and upgrade layout, structure and usability of our services;
to provide you the possibility to take part in any interactive functions of our services (e.g., functions that require your phone number);
to process any activity that you exercise while using our services, as well as purchasing our services and products;
to customize your use of and repeat visits to our services;
to send you notifications regarding any compatible matches or any matches that are close to your location area;
to provide you with data related to our services, products and/or offers if you requested such data from us;
to provide you with responses to your questions, queries, requests and/or comments;
to send you notifications about any changes, amendment or alterations of our services or their functionality;
to conduct analysis and research of market;
to be sure that you follow all the provisions listed in the Agreement and that you follow all obligations established by applicable laws and regulations.

Provision of Our Services and Products
The data that we collect from you is used for the following purposes:
to answer and carry out your requests for our services, products and programs;
to answer your requests related to our offers;
to customize, improve, upgrade and provide our offers;
to provide you with our, our business partners, our affiliates or selected third parties offers or other services, products, programs that in our opinion may be interesting to you;
to carry out analysis and research related to your interest in, and use of services, products, content and offers provided by us, our partners, affiliates or third parties;
to provide you with, develop and display advertisings, promotions, content that will be in accordance with your preferences and that will be based on your use of our application, or other websites and applications and as well as to provide you with our advertisements and promotions on the third parties websites or applications that you visit. We also use data that we gather for our communities and online forums for the purpose of provision of inter-active experience. Moreover, we use such data to ease your use and participation in our communities and online forums and to offer you services, products and/or programs.
If you decide to submit content we reserve the right to make public your username and other data that you provided to us, we may publish such data on our application, on the Internet or anywhere else.
Profiling
We provide so called “profiling” feature on our services for you to use our services in the most effective way. This profiling feature makes analysis of your data and on the basis of this analysis it suggests the best possible match for you. You agree to such profiling when you put a tick in the consent box upon the stage of registration of your profile.
Communications
We use your data for communication purposes, including:
to send you notifications when we change, alter or amend the Agreement;
in any other way exercise or enforce our rights listed in the Agreement;
to carry out your request for an online newsletter;
to get in touch with you regarding your profile (e.g., for provision of customer support services and managing your profile).
You may decide to receive push notifications from us, if such feature is offered to you. Please be informed that any communications between our users are made via our internal systems with the help of which you may send and receive messages. Such systems generate an email notice which will contain only the data of the name of your profile and the data you entered into your profile.
The data that you provide to us about other persons (e.g., those you have in your contact list) is used by us to send them gifts, invitations, cards or any other content on your behalf. Sometimes we may also use such data to send them offers of our or third parties services, products or programs.
Use of Mobile Device Data
If you use your mobile device to access our services we reserve the right to use data collected from such device in accordance with any purpose described in this Privacy Policy.
Non-Personal Data Usage
We use aggregate and non-personal data of our users for the purposes of improvement and upgrading of our content, design and functionality of our services and to individualize your user experience and to provide you with offers that will meet your preferences.
In details, we use such data to:
personalize, maintain, provide, protect, develop, improve and upgrade our services, products and programs and manage our business;
perform analysis of our application, in particular, to analyze the volume and other characteristics of performance and usage of our application and to exercise the advertisement tracking;
offer you with services, products and programs provided by us, our affiliated, our business partners or third parties.
Safety
We reserve the right to check and monitor your activity that you exercise while using our services to understand if you follow and do not infringe any provisions of the Agreement and this Privacy Policy and also to monitor any activity that may be suspicious. Such monitoring and checks may be exercised in relation to your profile, content generated by you, photos, chat histories, messages and any other communications and any other activities that you may exercise while using our services.
Creation of Duplicate Profiles on the Websites and Applications of Our Partners
After you complete your registration process on our application we will send you an email notification which will tell you that we created a duplicate profile on the website or application of our partner, this is done for the purpose of increasing the possibility suitable matches. When you receive such notification from us you will be able to refuse from this option for free.
How We Use Your Photos and Other Content
As described in the Agreement you provide us with license to use the photos that you uploaded on our services for commercial and advertising purposes and for free. If you want to know more about this please familiarize yourself with section “Use of Content Generated by You” of the Agreement. Such content may include your name, age, image, likeness data about closest city to the place of your residence, such data may be used for advertising, marketing and promotional purposes. You reserve the right to cancel such license in accordance with provisions of the Agreement.
How We use Your Contact Data
When you decided to provide us with data about your contact(s) (this may include name, mobile number and/or email address of the contact) you give us permission to send a notice to such contact(s) which will contain invitation to join and enjoy our services. Such invitation will be sent on your behalf by email, SMS or through network. We will keep the contact data that you provided to us for the sole purpose of invitation to join our services and for connection of such contact with you and other people he/she may know. If the contact invited by you does not want us to keep his/her data that was uploaded on our services, he/she may contact our customer support team with request to remove such data. We will erase the data about contact invited by you after we will send him/her the invitations, the number of invitations will not exceed 3 times. Contact(s) that you invited will receive future notifications from us only if he/she/they decided to accept the invitation to join our services or if you decided to use any tool available on our services with the help of which you may share your experience with your contacts, and you have provided us with data of such contacts once more.
6. Disclosure of Your Data
Disclosures Required by Law
We may be obliged by law, court order, actual or potential litigation, official orders of public or government bodies or any other applicable rules or regulations (that may be issued by your local or foreign authorities) to make disclosure of any part or all of the data that we hold on you to third parties. We also reserve the right to make such disclosure if in our opinion it is necessary to do so (e.g., in case of official request of law enforcement authorities, issues connected with national security, alleged violation of trade marks, copyright or any other infringement of third party rights by our user).
Third Party Service Providers
We disclose your data to the third parties that help us to provide our services to you. Such third parties help us with (e.g., credit and payment processing, managing and hosting data, fulfilment of user orders, carrying out consumer researches, data processing, etc.). Such data share is related to provision of our services, improvements and upgrades of our services, providing you with targeted advertising and promotions. We will not provide your contact data for the purposes of direct marketing, promotion or advertising executed by such third parties without obtaining your prior direct consent. We do not keep your credit card details and we do not share or disclose such data to any third parties.
Change of Ownership, Mergers and Acquisitions
We reserve the right to sell or buy assets. If such transaction takes place the data that we gather about you will be one of the assets transferred during such transaction. Transfer of your data as one of the assets will also take place if assets of our company will be purchased. In context of any case described above in this subsection we may disclose your data to:
other companies in our corporate group;
a person who may be a potential buyer or buyer of our business;
professional advisers who take part in preparation of the transaction, e.g. our lawyers, they will receive only specific amount of data which is necessary for them to fulfill their duties;
other persons if we are obliged to disclose your data in order to fulfill any applicable legal obligation.
Business Partners
When you register your profile or purchase any products or services on our application or click-through our advertisements or promotions that are shown on applications or websites of third parties we reserve the right to disclose your personal data to our business partners in order to offer you services, products, promotions or advertisements. When you decide to take part in specific program or offer of a merchant you provide us with your explicit permission to disclose your email address and other data to such merchant.
Servers of Advertisement
On our services you are able to look through advertisements and promotions of third parties. Such third parties may also provide us with reporting, app analytics, advertisement response measurement, data collection and provide us with assistance in distribution of promotion and advertisement messages. Such third parties may set, view or edit Cookie files. The use of Cookies by such third parties shall be governed by provisions of their privacy policies and this Privacy Policy.
Aggregated or Non-personal Data
We reserve the right to disclose your non-personal data that we gather from you following any of the above-mentioned circumstances. We also reserve the right to disclose and share such data to entities and/or third parties for the purpose of distribution, delivering and developing of targeted advertisements and promotions, whether on our application or on the applications and/or websites owned by third parties and to provide analysis and reports about the advertisements and promotions you see. We reserve the right to aggregate non-personal data that we gather with other non-personal data gathered from other sources.
7. Marketing
Direct Marketing
We reserve the right to disclose and share your data with websites and/or applications owned by our business partners, such data disclosure will be made with the purpose of delivering, developing and distributing services and products of our business partners to our users and/or assist us in preparation of marketing reports. We reserve the right to deliver and distribute the data related to services, products, offers and news of our business partners and/or third parties that in our opinion may suit your preferences. We reserve the right to provide such marketing via email or phone, by using the data you have provided to us. Any message that we send to you (following your prior consent) will indicate that it is sent from us. You reserve the right at any time to opt-out from marketing messages that we may send to you, you may do so by following the instructions listed below.
Third Parties Marketing
If you agreed to receive marketing messages from third parties that are further referred as "partner services", we reserve the right to share your data with such third parties on the basis of data sharing agreement that we conclude with them, this will be done for analytical reporting and data sharing purposes. We shall bear no responsibility for the data and content that such third parties provide to you in messages or on their services and products that they advertise and promote. If after you agreed to receive such messages you changed your mind, you reserve the right to opt-out from such communications at any time, you may exercise this right by following the provisions listed below. Please also be informed that you will have to contact third parties whose marketing communications you have agreed to receive if you do not want to receive such communications anymore.
Right to Opt-Out from Marketing
If you changed your decision and do not wish to receive marketing communications anymore you reserve the right to exercise your opt-out right by amending your preferences in the “My Profile” section of our application or sending us an email to: Email: support@flirtini.com. You may also have to follow other provisions described above in this section.
8. Where Your Data Is Stored
We may transfer and store the data that we collect from you (including your personal data) to location that is placed outside the European Economic Area ('EEA'). Your data may be transferred and stored including, but not limited to Canada where our servers are hosted. Your data may be also processed by law enforcement authorities and/or by our/our business partners employees or independent contractors that are placed outside the EEA (e.g., specialists who take part in provision of our services to you, provide you with support services or process your payment data). When you submit your data (including your personal data) you give us your consent to such storing, transfer and processing. We will take all reasonable steps to secure your data in accordance with provisions of this Privacy Policy. Also, following the provisions of the Data Legislation we conclude binding processor agreements with third parties that take part in processing of your data.
9. For How Long We Store Your Data
In general, we keep your data for the term equal to the period during which we provide you with our services and products which lasts until the cancellation of your profile.
From the perspective of the data storage our users are divided in several categories:
Active users – you log into our services on a regular basis and use our services. If you are recognized as active user we will keep your data until the cancellation of your profile.
Inactive users – your profile was not cancelled but you did not log into or made any activity on our services for the terms more than 9 months. In such case we will continue to keep your data until cancelation of your profile and you will receive marketing communications which you agreed to receive. We believe that you will return to use our services even after you did not access our services for a few months and we will not erase your data for your convenience and your profile will be visible for other users and shown in search results. You shall bear sole responsibility for cancellation of your profile or for making changes in your preferences.
Cancelled users- you completed the cancellation process and cancelled you profile. If you cancelled your profile following all instructions listed on our services we will erase all the data that we hold on you 9 months after the date of such cancellation took place. It is important for us to store your data for such term because we want to be sure that we will be able to answer all requests related to your profile that we may receive from third parties (e.g., any requests related to payments processing, official requests of enforcement authorities or any other requests as described in provisions of this Privacy Policy). Even after you cancelled your profile and erased your data, copies of such data may be still accessed and viewable on the Internet to the extent you shared, posted or in any other way disclosed such data to others, if it was copied by others or if such data was shared with search engines. We are not able to control this and we shall bear no responsibility for this. If you submitted your data or gave your consent to collect your data to any website or application owned by third parties they will store your data in accordance with provisions of their terms of use and privacy policies.
Activity Data Storage
Without restrictions to provisions listed above in this section, we store some types of data for different amount of time. We store your likes and other similar activities for 10 days and your messages for 30 days. Other data related to your profile and activities you exercise on our services (e.g., search histories, blocked list, photographs, etc.) shall be stored for 9 months terms after the cancellation of your profile.
Users Whose Profile Was Banned or Terminated
If we terminate your profile or if you are subject to a fraud ban because you exercised any fraudulent activity or made any attempts to exercise such fraudulent activity or you exercised any type of threat whether actual or potential in relation to us or our users we will store you email address in our blacklist for the period necessary for protection of our business and users.
10. Security
Data transmission through internet cannot be 100% secure. We provide all commercially reasonable efforts to secure your personal data but we are not able to guarantee safety of transmission of your data to our application, any kind of data transmission is exercised at your own risk. We take reasonable physical, electronic and administrative measures established to secure and protect your data from unlawful and unauthorized disclosure or access. For example, we use Secure Sockets Layer (SSL) software that stores your data in the encrypted form behind a firewall that blocks unauthorized access that any third party may try to get. Unfortunately, even after we apply all reasonable efforts to secure your data we still are not able to guarantee 100% security of your data transfer via Internet. We also cannot guarantee that your personal data that we gather from you will not be disclosed, shared or in any other way used in breach of provisions of this Privacy Policy. We shall bear no responsibility for disclosure of your data that happened because of unauthorized access, transmission errors, or under any other grounds that are beyond our reasonable control.
We kindly ask all our users to exercise caution and be careful while disclosing any data about themselves.
We recommend and ask you not to share, post, insert to your profile or in any other way disclose any data that contains URLs, email addresses, phone numbers, instant messaging details, credit card details, full names or addresses, drivers’ license details, national identity numbers or any other sensitive data that may be misused or abused.
We kindly ask you to exercise caution when you post, share or in any other way disclose any sensitive data about yourself (e.g., data about your health, data regarding your religion beliefs, etc.). You have a right but not obliged to provide your sensitive data that you may fill in while registration of your profile (e.g., data about your ethnic origin, sexual preferences, etc.).
Please be informed that any video or photo that you post, share or in any other way disclose may also contain any kind of sensitive personal data listed above. If you upload or submit to our services any sensitive data about yourself when you do so you provide us with your explicit consent to our processing of such data and authorize us to publishing such data so other users may view it.
When you post, share or in any other way disclose any data about yourself you shall bear sole risk and responsibility for the amount of data that you disclose about yourself. Also, your posts may be shown on other applications or when someone will search for the post with the same subject matter. If you post, share or in any other way disclose any content or data that explicitly or implicitly breaches any provision of the Agreement we may terminate your profile.
11. Cookie Policy
We reserve the right to use Cookies to gather data from the device that you use to access our services. If you use our services you provide us with your explicit consent to our use of Cookies in accordance with provisions of this section and our Privacy Policy. Cookies are text files that are placed on your device by applications or websites that you access. Cookies provide us with data that cannot identify you as a person but is recognized as statistical data that allows us to understand your preferences, user experience and browsing habits and to customize our services in accordance with your needs. We use Cookie technologies for different purposes (e.g., they help us to collect data during your subscription and to have better understanding of trends and preferences of our users, improve safety of our services and to share non-personal data that we collect from you with third parties for the marketing, advertising and promotion purposes).
In details, Cookies give us an opportunity to:
evaluate and understand the amount of our users and usage pattern;
collect and keep the data about your preferences and individualize our services following your browsing habits, user experience and preferences;
